General Terms and Conditions

These General Terms and Conditions apply to all contracts, deliveries, and other services. Deviating, conflicting, or supplementary terms and conditions are not part of the contract.

Important Notice! Returns will only be accepted with our official return form.

1. Right of Withdrawal / Returns

You may revoke your contractual declaration within 14 days by providing reasons in written form via email and/or by returning the goods using the return form. The withdrawal period begins upon receipt of the goods. To meet the withdrawal deadline, it is sufficient to send the withdrawal or the goods in a timely manner. The withdrawal must be addressed to the following address:

1.a. Consequences of Withdrawal

Exercising the right of withdrawal converts the purchase contract into a reverse transaction, whereby the performances received under the purchase contract must be refunded. Goods received must be returned within 14 days of declaring the withdrawal. We will also refund you within 14 days of receiving your withdrawal. However, we may withhold the refund until we have received the goods back or you have provided proof of returning the goods, whichever is earlier. Please promptly return the goods in case of withdrawal: We ask you to use the attached form or the online form provided with the invoice/delivery note to fill out and return the goods to us.

Please note that the right of withdrawal does not apply to the following products:

• Returns of used items
• Items without or with damaged original packaging
• Sealed items that are not suitable for return due to health or hygiene reasons or due to food regulations, if the seal has been removed after delivery. This includes opened or unopened shisha tobacco
• For further warranty information, see section 6.

In the case of an unjustified return, please provide a brief explanation. Return shipping costs are to be borne by you. We will promptly refund the purchase price upon receipt of the goods or credit it to your customer account. We reserve the right to deduct compensation for any damage or excessive wear from the refund if any loss in value is attributable to handling the goods that was not necessary to ascertain the nature, characteristics, and functionality of the goods.

If a shipment is returned to us by the postal service for the following reasons, the order will be automatically cancelled upon notification to the customer:

• Package not picked up
• Recipient unknown

In special cases, a reshipment of the package is possible, but a flat fee of CHF 10.00 will be charged.

1.b. Damage

If our shipment arrives damaged, please bring the damaged product with its packaging and packing material immediately to the local post office and fill out a damage report there.

Request a copy and send it to us as a photo or scanned with the subject "Return" to info@revolutiontobacco.com, so that you can claim your right to receive intact goods.

Externally non-apparent damages must be reported to the responsible post office of your municipality within 14 days of delivery.

If the shipment does not arrive within 5 days of receiving the shipping confirmation, it is the customer's responsibility to notify us immediately.

A search for a customer's shipment will only be initiated by the shipper if the customer has duly reported it.

However, if the customer has not properly reported the non-delivery, a search must be initiated directly with the postal service by the customer.

2. Shipping

We generally ship with Swiss Post or DPD. Shipping costs are calculated based on the current provider's prices. (Link to shipping costs)

3. Offer

All items are deliverable according to the availability indicator on the product pages.

Minor deviations from the illustrations of the goods are possible.

4. Payments and Deliveries

The final price of the order includes VAT plus the specified shipping costs. Your items will usually be shipped immediately after the purchase amount is credited to our account. You will also receive a shipping notification by email. Claims for damages due to delays or impossibility or non-performance, including those arising until withdrawal from the contract, are excluded.

If the shipment does not arrive within 5 days of receiving the shipping confirmation, it is the customer's responsibility to notify us immediately. A search for a customer's shipment will only be initiated by the shipper if the customer has duly reported it. However, if the customer has not properly reported the non-delivery, a search must be initiated directly with the postal service by the customer.

By placing an order, the buyer accepts our payment terms and the payment methods provided by us. Further reference is made to our payment methods [link to payment methods].

5. Reservation of Title

In contracts with consumers, the goods remain our property until full payment of the purchase price. In contracts with entrepreneurs, the seller reserves ownership of the goods until all claims from an ongoing business relationship have been settled. The entrepreneur is entitled to resell the goods in the ordinary course of business. The entrepreneur hereby assigns to the seller all claims arising from the resale against a third party up to the invoice amount. The seller accepts the assignment. After the assignment, the entrepreneur is entitled to collect the claim. The seller reserves the right to collect the claim himself if the entrepreneur does not fulfil his payment obligations properly and is in default of payment.

6. Warranty

We warrant that the goods are free from material and manufacturing defects at the time of transfer of risk and possess the contractually assured properties. Upon receipt of the goods, the buyer must immediately inspect them for quality and defects. Open defects must be reported to us in writing within 7 working days. The warranty period is defined by statutory warranty claims and is 24 months. In the event of a complaint, the claimed item must be sent in with sufficient postage. The warranty does not cover normal wear and tear or use. It expires if the customer alters the delivered goods. During the warranty period, the buyer is entitled to free rectification. Partial or complete replacement of the item is permissible. If defects are not rectified within a reasonable period, the buyer is entitled to rescind or reduce the purchase price.

All warranty obligations are excluded for:

Items without a purchase receipt, shisha tobacco (even if unopened), and disposable/hygiene products.

7. Data Protection Statement

We would like to inform you that the data necessary for business processing will be processed and stored. The customer has been extensively informed about the nature, scope, location, and purpose of the collection, processing, and use of personal data required for order execution by the seller.

We use the data you provide to fulfil and process your order. When registering for the newsletter, your email address will be used for our own advertising purposes until you unsubscribe from the newsletter. Unsubscribing is possible at any time.

The protection of your privacy is very important to us. Below, we provide detailed information on how we handle your data.

7.a. Website Statistics This website uses Google Analytics, a web analytics service provided by Google Inc. ("Google"). Google Analytics uses "cookies," which are text files placed on your computer, to help the website analyze how users use the site. Furthermore, you can request that your data be deleted if it is no longer required for contract processing and also request the blocking of your data. 8. Legal Age

By accepting these terms and conditions, the customer confirms that they have reached the age of 18. The age must be truthfully stated in the user profile. Any costs incurred due to incorrect disclosure of the birth date are fully borne by the customer or their legal representative.

9. Formation of Contract

The presentation of products in the online shop is not a legally binding offer but merely an unbinding online catalog. Placing products in the "shopping cart" does not constitute a binding order. A binding order for the products contained in the shopping cart is placed by clicking the "Order" button on the order page. The receipt of this order is confirmed immediately by automated email and does not yet constitute acceptance of the contract.

We can accept the contract with you by sending a contract confirmation or by delivering the goods within five days.

10. Final Provisions and Severability Clause

Place of performance is Aadorf. The business has the right to sue the customer in any other court. Swiss law applies. If the customer is a merchant or legal entity under public law, Aadorf is the exclusive place of jurisdiction for all disputes arising from this contract. The same applies if the customer has no general place of jurisdiction or residence in Switzerland or if their place of residence or habitual abode is not known at the time the action is filed.

Should individually provisions of the contract - including these terms and conditions - be or become invalid in whole or in part, this shall not affect the validity of the remaining provisions. Rather, the invalid provisions shall be replaced by a provision that is legally effective and comes closest in content and purpose to the ineffective provisions.
